1. Agreement to Terms

Welcome to Animy. These Terms of Service ("Terms") form a binding agreement between you and Individual Entrepreneur Atambaev Nurbek Kerimovich, registered in the Kyrgyz Republic ("Animy," "we," "us," or "our"), the operator of the Animy brand, the animy.ai website, and related applications and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Service.

1.1 Age Requirements

You must be at least 13 years old to use the Service. If you are under 18 years of age, you may only use the Service with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf and accepts responsibility for your activity on the Service. The Service is not directed to children under 13, and we do not knowingly allow children under 13 to create accounts or use the Service.

1.2 Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the Effective Date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of the Service

Animy is an AI-powered creative platform that allows users to:

• Upload drawings or create drawings within the Service;
• Transform drawings into AI-generated stylized images;
• Generate short animated videos from drawings;
• Store, organize, view, download, and share resulting content.

The Service relies on third-party artificial intelligence and machine learning technologies (including, but not limited to, Google Gemini and Kling AI) to process and transform user content.

3. User Accounts

3.1 Account Creation

To use most features of the Service you must create an account. You agree to provide accurate, current, and complete information, and to keep this information up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

3.2 Authentication

Accounts are authenticated via magic link (passwordless email authentication). You are responsible for maintaining the security of the email address associated with your account.

4. User Content and Intellectual Property

4.1 Your Content

"Your Content" means any drawings, images, text descriptions, prompts, or other materials that you upload to, create within, or generate through the Service, including AI-generated images and animations produced from inputs you provide.

You retain full ownership of Your Content, including all stylized images and animated videos generated from your inputs. You may use Your Content for personal or commercial purposes, subject to these Terms and our Acceptable Use rules in Section 6.

If you are on the free tier of the Service, content you download or share from the Service includes an Animy watermark. Paid-tier outputs are delivered without a watermark. Removal or alteration of the watermark on free-tier outputs is not permitted.

4.2 License You Grant to Animy

By using the Service, you grant Animy a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, process, display, and create technical copies of Your Content, solely as necessary to:

• Operate, maintain, and provide the Service to you;
• Generate the stylized images, animations, and other outputs you request;
• Improve the performance, reliability, and safety of the Service in aggregate, non-identifiable form.

This license is limited to operating the Service and does not allow us to sell, sublicense for unrelated purposes, or otherwise distribute Your Content outside the Service without your further permission. The license terminates when you delete Your Content or your account, except for backups and copies that are part of our routine technical processes and are deleted on the schedule described in our Privacy Policy.

4.3 Animy Intellectual Property

The Service, including its design, features, software, trademarks, the Animy name and logo, and all associated intellectual property other than Your Content, is owned by us and protected by applicable law. These Terms do not grant you any right to use the Animy name, logo, or trademarks without our prior written permission. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service except as expressly permitted by law.

4.4 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us a perpetual, royalty-free, worldwide license to use that feedback without restriction or compensation to you.

5. AI-Generated Content

5.1 Nature of AI Output

Stylized images and animations produced by the Service are generated by artificial intelligence algorithms. You acknowledge that:

• AI-generated content may not perfectly reflect your input drawing or description;
• Output quality may vary based on the complexity, clarity, and style of your input;
• AI may interpret abstract or ambiguous inputs in unexpected ways;
• Results may vary between identical or similar submissions due to the stochastic nature of AI generation;
• AI may occasionally produce unexpected, biased, or unintended visual elements despite our safety measures.

You are solely responsible for reviewing, verifying, and deciding how to use any AI-generated output before relying on it, sharing it, or putting it to commercial use. The Service is provided for creative and entertainment purposes and does not constitute professional advice of any kind.

5.2 Content Safety Screening

All uploaded drawings undergo automated AI-powered content safety screening before being processed. Inputs that depict violence, sexual themes, hate symbols, realistic weapons, drug imagery, or other prohibited material are automatically blocked and will not be processed. Our screening system may produce false positives; we apologize for any inconvenience this may cause and continuously work to improve accuracy.

5.3 Third-Party AI Providers

Animy uses third-party AI services to power its features. Your use of the Service is also subject to the acceptable use policies and terms of these providers. Animy does not guarantee uninterrupted availability of these third-party services, and service interruptions, delays, or quality variations may occur due to third-party issues outside our control.

5.4 No Use of Your Content to Train Animy Models

Animy does not use Your Content to train its own AI models. However, third-party AI providers may have their own data-handling and training practices governed by their own privacy policies. See our Privacy Policy for details on how Your Content is handled by these providers.

6. Acceptable Use

6.1 Permitted Uses

The Service is intended for personal and commercial creative projects in compliance with these Terms and all applicable laws.

6.2 Prohibited Content

You may not upload, submit, or attempt to generate content that depicts or contains:

• Sexually explicit, pornographic, or suggestive material of any kind;
• Sexual content involving minors, child sexual abuse material, or any content that exploits, endangers, or sexualizes children — these prohibitions are absolute and are not negotiable;
• Graphic violence, gore, torture, or realistic depictions of physical harm;
• Realistic firearms, knives, explosives, or other weapons depicted in harmful contexts;
• Hate symbols, hate speech, or content that promotes discrimination based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic;
• Content that promotes self-harm, suicide, or dangerous activities;
• Depictions of illegal drugs, drug paraphernalia, or content promoting drug use, especially to minors;
• Real identifiable people without their consent, including photographs used as references;
• Content that infringes anyone's intellectual property, privacy, or publicity rights;
• Personally identifiable information of any individual (especially minors);
• Malware, viruses, or any other malicious code;
• Content that is unlawful, defamatory, fraudulent, deceptive, or otherwise objectionable.

6.3 Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law;
• Attempt to bypass, disable, or circumvent content safety filters, moderation systems, watermarks, or access controls;
• Use automated tools (bots, scripts, scrapers) to access or interact with the Service without our prior written authorization;
• Reverse-engineer, decompile, or attempt to extract source code or model weights from the Service;
• Intentionally overload the Service, interfere with its operation, or attempt to gain unauthorized access to other users' accounts or restricted areas;
• Create multiple accounts to circumvent usage limits, free-tier caps, or account suspensions;
• Sell, rent, lease, or transfer your account to any third party;
• Use the Service to generate deepfakes, impersonate real people, or create misleading content for deceptive purposes;
• Submit chargebacks, payment disputes, or refund requests in bad faith.

6.4 Content Moderation and Removal

We reserve the right to review, refuse, remove, or refuse to generate any content that we believe, in our sole discretion, violates these Terms or is otherwise objectionable. We may also suspend or terminate accounts that repeatedly violate our policies, with or without notice.

7. Subscriptions, Payments, and Refunds

7.1 Free and Paid Plans

Animy offers a free tier with limited capacity (drawings, stylizations, and animations) and paid subscription plans (Plus and Pro) that provide additional monthly capacity, the option to use generated content for commercial purposes, and other features described in the Service. Plans are available in weekly, monthly, and annual billing periods. Current pricing is displayed within the Service before checkout.

7.2 Payment Processing — Paddle as Merchant of Record

All payments and subscriptions are processed by Paddle.com Market Limited ("Paddle"), acting as Merchant of Record for transactions on the Service. This means:

• Paddle is the entity that charges your payment method;
• Paddle is the seller of record for the transaction;
• Paddle issues your invoice or receipt and is responsible for collecting and remitting any applicable VAT or sales tax in your jurisdiction;
• Paddle, not Animy, appears as the merchant on your bank or card statement.

By purchasing a subscription you also agree to Paddle's Buyer Terms and Conditions, available at https://www.paddle.com/legal/checkout-buyer-terms-and-conditions. You can also manage your subscription, request a refund, or contact billing support directly through Paddle at https://paddle.net.

7.3 Automatic Renewal

Paid subscriptions renew automatically at the end of each billing period (weekly, monthly, or annual) at the then-current price, unless you cancel before the renewal date. You may cancel at any time through your account settings or through paddle.net. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.

7.4 Refunds

Animy is a digital service with substantial per-use computational costs (each stylization and animation triggers paid third-party AI processing). As a general policy, subscription payments are non-refundable once a billing period has begun. Full details of when refunds are available — including statutory rights for EU and UK consumers, billing errors, duplicate charges, and material extended outages — are set out in our separate Refund Policy.

7.5 Price Changes

We may change subscription prices at any time. Existing subscribers will be notified before any price change takes effect, and the new pricing will apply at the start of the next billing period after the notice period. You may cancel before the new price takes effect.

8. Account Termination

8.1 Termination by You

You may delete your account at any time through your account settings. Upon deletion, all data associated with your account (including uploaded drawings, stylized images, and generated animations) will be permanently removed from our systems in accordance with our Privacy Policy. Note that content previously transmitted to third-party AI providers may remain on their servers for a short period pursuant to their data-retention policies.

8.2 Termination by Animy

We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, our Acceptable Use rules, or applicable law, or if continued provision of the Service to you presents a risk to us, to other users, or to the integrity of the Service. Termination for policy violation results in forfeiture of any remaining subscription balance and does not entitle you to a refund.

8.3 Inactive Accounts

Accounts with no login activity for 365 or more consecutive days and no active paid subscription will receive a notification by email. If no action is taken within 60 days of that notification, the account and all associated data may be permanently deleted.

9. DMCA and Copyright

If you believe content available through the Service infringes your copyright, please send a DMCA takedown notice to team@animy.ai. Your notice must include: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location on the Service; (c) your contact information; (d) a statement of good-faith belief that the use is not authorized; (e) a statement of accuracy under penalty of perjury; and (f) your physical or electronic signature.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, RELIABLE, SUITABLE FOR ANY PURPOSE, OR FREE OF UNEXPECTED ELEMENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANIMY OR ITS OWNER, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

• Your use of, or inability to use, the Service;
• Any AI-generated content created through the Service;
• Unauthorized access to or alteration of your data;
• The conduct or content of any third party (including third-party AI providers and Paddle);
• Any other matter relating to the Service.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED FIFTY UNITED STATES DOLLARS (US $50.00) OR THE AMOUNT YOU PAID TO PADDLE FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU IN FULL.

12. Indemnification

You agree to defend, indemnify, and hold harmless Animy and its owner, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property, privacy, or publicity rights; (d) your violation of any applicable law; or (e) any content you upload, generate, or share through the Service.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Kyrgyz Republic, without regard to its conflict-of-laws principles. Any disputes arising under or in connection with these Terms shall be resolved in the competent courts of the Kyrgyz Republic, except where applicable consumer-protection law in your country of residence grants you the right to bring proceedings before your local courts.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Animy regarding the Service and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.3 No Waiver

Our failure to enforce any provision shall not constitute a waiver of that provision.

14.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction, including in connection with a sale of the business or its assets.
